The meeting opened at 10.02 am.

1. Subordinate legislation: The Committee took evidence on the Community Care (Personal Care and Nursing Care) (Scotland) Amendment Regulations 2011 from—

Shona Robison MSP, Minister for Public Health and Sport, and Shaun Eales, Policy Officer for Care at Home and Free Personal Nursing Care, Scottish Government.

2. Subordinate legislation: Shona Robison MSP (Minister for Public Health and Sport) moved S3M-07889—

That the Health and Sport Committee recommends that the Community Care (Personal Care and Nursing Care) (Scotland) Amendment Regulations 2011 be approved.

The motion was agreed to.

3. Subordinate legislation: Shona Robison MSP (Minister for Public Health and Sport) moved S3M-07874—

That the Health and Sport Committee recommends that the Public Services Reform (Scotland) Act 2010 (Consequential Modifications) Order 2011 be approved.

The motion was agreed to.

4. Subordinate legislation: Shona Robison MSP (Minister for Public Health and Sport) moved S3M-07882—

That the Health and Sport Committee recommends that the Social Care and Social Work Improvement Scotland (Requirements for Care Services) Regulations 2011 be approved.

The motion was agreed to.

5. Subordinate legislation: The Committee took evidence on the National Health Service (Free Prescriptions and Charges for Drugs and Appliances) (Scotland) Regulations 2011 (SSI/2011/55) from—

Shona Robison MSP, Minister for Public Health and Sport, Tom Wallace, Policy Manager, Health and Healthcare Improvement, Dr Catriona Hayes, Statistician, Health Analytical Services, and Nicholas Duffy, Solicitor, Health and Community Care, Scottish Government.

6. Subordinate legislation: Mary Scanlon MSP moved S3M-8011—

That the Health and Sport Committee recommends that nothing further be done under the National Health Service (Free Prescriptions and Charges for Drugs and Appliances) (Scotland) Regulations 2011 (SSI/2011/55).

After debate, the motion was disagreed to (by division: For 2, Against 6, Abstentions 0).

7. Subordinate legislation: The Committee considered the following negative instruments—

the National Health Service (Pharmaceutical Services) (Scotland) Amendment Regulations 2011 (SSI/2011/32);

the National Health Services (Superannuation Scheme and Pension Scheme) (Scotland) Amendment Regulations 2011 (SSI/2011/53);

the Natural Mineral Water, Spring Water and Bottled Drinking Water (Scotland) Amendment Regulations 2011 (SSI/2011/94);

the Food (Jelly Mini-Cups) (Emergency Control) (Scotland) Revocation Regulations 2011 (SSI/2011/95);

the Food Additives (Scotland) Amendment Regulations 2011 (SSI/2011/99), and

the Health Professions Council (Registration and Fees) (Amendment) (No. 2) Rules 2010 Order of Council 2011 (SI/2011/210).

The Committee agreed to make no recommendations in relation to the instruments.

8. Certification of Death (Scotland) Bill: The Committee considered the Bill at Stage 2 (Day 1).

The following amendments were agreed to (without division): 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13 and 14.

The following amendments were moved and, with the agreement of the Committee, withdrawn: 15, 16, 21 and 22.

The following amendments were not moved: 17, 18, 19 and 20.

Sections 1, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 15, 16, 18, 19, 20, 21, 22, 24, 25, 26, 27, 29, 30 and 31 and the long title were agreed to without amendment.

Schedule 1, sections 2, 14, 17, 23 and 28 and schedule 2 were agreed to as amended.

The Committee completed Stage 2 consideration of the Bill.

9. Legacy paper (in private): The Committee considered and agreed a revised draft legacy paper.

The meeting closed at 11.59 am.
