Audit Committee
9 January 2007
1st Meeting, 2007

The Committee will meet at 10.00 am in Committee Room 1

1. Post Legislative Scrutiny: The Committee will consider a response to the Finance Committee on post legislative scrutiny.

2. Section 22 Reports: The Committee will consider responses in relation to the section 22 reports entitled "The 2005/06 Audit of Argyll and Clyde Health Board" and "The 2005/06 Audit of Highland Health Board".

3. Relocation of Scottish Executive Departments, Agencies and NDPBs: The Committee will take evidence on its inquiry into the AGS report entitled "Relocation of Scottish Executive Departments, Agencies and NDPBs" from—

Ross Finnie MSP, Minister for Environment and Rural Development.

Proposed future business

At a future meeting the Committee will consider a draft report on its inquiry into Community Planning.

The Committee will meet at 10.30 am in Committee Room 6

1. Delegated powers scrutiny: The Committee will consider the delegated powers provisions in relation to the following bill—

Criminal Proceedings etc (Reform) (Scotland) Bill as amended at Stage 2.

2. Legislative consent memorandum: The Committee will consider the powers to make subordinate legislation conferred on Scottish Ministers in the Further Education and Training Bill.

3. Legislative consent memorandum: The Committee will consider the powers to make subordinate legislation conferred on Scottish Ministers in the Statistics and Registration Service Bill.

4. Executive responses: The Committee will consider Executive responses in relation to the following instruments—

the Scottish Local Government Elections Order 2007, (SSI 2006/draft); and

the Water Services etc. (Scotland) Act 2005 (Commencement No. 5) Order 2006, (SSI 2006/599).

5. Draft instruments subject to approval: The Committee will consider the following—

the Conservation (Natural Habitats &c.) Amendment (Scotland) Regulations 2007, (SSI 2006/draft);

the Rehabilitation of Offenders Act 1974 (Exclusions and Exceptions) (Scotland) Amendment Order 2007, (SSI 2006/draft); and

the Scottish Parliament (Disqualification) Order 2007, (SI 2006/draft).

6. Instruments subject to annulment: The Committee will consider the following—

the Personal Injuries (NHS Charges) (General) (Scotland) Regulations 2006, (SSI 2006/592);

the Personal Injuries (NHS Charges) (Reviews and Appeals) (Scotland) Regulations 2006, (SSI 2006/593);

the Less Favoured Area Support Scheme (Scotland) Amendment Regulations 2006, (SSI 2006/601);

the Prohibition of Fishing with Multiple Trawls (No. 2) (Scotland) Amendment Order 2006, (SSI 2006/602);

the Teachers’ Superannuation (Scotland) Amendment (No. 2) Regulations 2006, (SSI 2006/605);

the Welfare of Animals (Transport) (Scotland) Regulations 2006, (SSI 2006/606); and

the Local Government (Discretionary Payments And Injury Benefits) (Scotland) Amendment Regulations 2006, (SSI 2006/609).

7. Instruments not laid before the Parliament: The Committee will consider the following—

the Registration of Births, Still-births, Deaths and Marriages (Prescription of Forms and Errors) (Scotland) Regulations 2006, (SSI 2006/598);

the National Health Service (Functions of the Common Services Agency) (Scotland) Amendment (No. 2) Order 2006, (SSI 2006/603);

the Police, Public Order and Criminal Justice (Scotland) Act 2006 (Commencement No. 2) Order 2006, (SSI 2006/607); and

the London Olympic Games and Paralympic Games Act 2006 (Commencement) (Scotland) Order 2006, (SSI 2006/611).

Proposed future business

At its next meeting on 16 January, it is expected that the Committee will consider its draft report into its inquiry into the regulatory framework in Scotland. The Committee will consider primary legislation, Scottish statutory instruments and any other documents subject to Parliamentary procedure.

The Committee will meet at 1.45 pm in Committee Room 1

1. Rights of Relatives to Damages (Mesothelioma) (Scotland) Bill (in private): The Committee will consider a draft Stage 1 report.

Proposed future business

At its next meeting on 10 January, it is expected that the Committee will consider a draft report on its inquiry into the Scottish Criminal Record Office.

The Committee will meet at 2.00 pm in Committee Room 4

1. Decision on taking business in private: The Committee will decide whether to take item 4 in private.

2. Tribunals, Courts and Enforcement Bill (UK legislation): The Committee will take evidence on the legislative consent memorandum from—

Alistair MacLeary, Chairman, Scottish Committee of the Council on Tribunals

and then from—

Johann Lamont MSP, Deputy Minister for Justice, Paul Cackette, Justice Department, William Fox, Education Department, Jane McLeod and Beth Elliot, Office of the Solicitor to the Scottish Executive, Scottish Executive.

3. Custodial Sentences and Weapons (Scotland) Bill: The Committee will consider a written response from the Scottish Executive.

4. Tribunals, Courts and Enforcement Bill (UK legislation): The Committee will consider the main themes arising from the evidence session, to inform the drafting of its report.

Proposed future business

At its next meeting on 16 January, it is expected that the Committee will consider the Christmas Day and New Year’s Day Trading (Scotland) Bill at Stage 2.

the Environmental Impact Assessment (Agriculture) (Scotland) Regulations 2006, (SSI 2006/582);

the Sheep and Goats (Identification and Traceability) (Scotland) Amendment (No. 2) Regulations 2006, (SSI 2006/594); and

Proposed future business

The Committee will continue to take evidence on its marine environment inquiry at subsequent meetings on 17 and 24 January. The Committee expects to begin consideration of the Aquaculture and Fisheries (Scotland) Bill at Stage 2 at its meeting on 24 January. 1. Legislative Consent Memorandum on the Consumer, Estate Agents and Redress Bill (UK Parliament legislation): The Committee will take evidence on memorandum LCM(S2) 9.1 on the Consumer, Estate Agents and Redress Bill, currently under consideration in the UK Parliament, from—
