Protection of Wild Mammals (Scotland) Bill - Stage 2

Amendments 47 - 50 inclusive have been lodged as manuscript amendments under rule 9.10.6

47 In section 1, page 1, line 4, leave out from <must> to <(1)> in line 5 and insert <who deliberately hunts a wild mammal with a dog, except for the purpose of controlling a pest species by means of an activity that does not involve the participation of any person on horseback>

48 In section 1, page 1, line 4, leave out from <must> to <(1)> in line 5 and insert <who deliberately hunts a wild mammal with a dog in the immediate pursuit of sport>

49 In section 1, page 1, line 5, at end insert-

<( ) For the purposes of subsection (1), a person acts in the pursuit of sport if that person acts solely or primarily in order to gain, or provide for others, pleasure or enjoyment from the activity.>

50 In section 1, page 1, line 5, at end insert-

<(1A) For the purposes of subsection (1), "pest species" means foxes, hares, rabbits, mink, rodents and such other species of wild mammal as the Scottish Ministers may, by order made by statutory instrument, specify as being liable to cause damage or nuisance.

(1B) A statutory instrument under subsection (1A) is subject to annulment in pursuance of a resolution of the Scottish Parliament.>
